Terms and Conditions of Hire
IMPORTANT LEGAL NOTICE
Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy available under the Australian Consumer Law (ACL).
However, the Hirer is fully responsible for any loss, damage, or costs arising from misuse, negligence, or failure to follow instructions.
Binding Agreement
By placing a booking with SNP Entertainment (ABN 74 374 526 451), the Hirer agrees to be bound by these Terms and Conditions.
Definitions
“Hirer” means the person or entity named on the invoice.
“Equipment” means all sound, lighting, accessories, cables and related items hired.
“Hire Period” means from collection/delivery until return and inspection.
“Owner” means SNP Entertainment.
Identification
Valid Victorian-issued photo identification must be provided and may be securely recorded or copied for verification, security, and equipment recovery purposes. Identification will only be disclosed where required by law or in the event of loss, theft, damage, or breach of this Agreement.
Residency & Eligibility
Equipment hire is available only to Victorian residents aged 18 years or over. The Hirer must provide valid Victorian-issued photo identification and a current Victorian residential address.
Where the equipment is used by an interstate or overseas person, a Victorian resident must act as the Hirer and assumes full legal and financial responsibility under this Agreement, regardless of who operates or uses the Equipment.
Security Bond
A refundable security bond is required. Deductions may be made for damage, loss, cleaning or late return. If costs exceed the bond, the Hirer remains liable.
Hire Period & Late Returns
Late returns incur fees of 50% of the daily hire rate per 4 hours overdue unless approved in writing.
Equipment Condition & Inspection
All equipment is supplied in tested, working condition. The Hirer must notify SNP Entertainment of any fault within 2 hours of collection.
Strict Prohibited Use (Examples of Misuse)
The following constitute misuse and negligence:
- Using speakers or equipment outdoors in rain, wet weather, dew or high humidity
- Allowing liquid, drinks, condensation or moisture near equipment
- Using generators, faulty power or unprotected outdoor power sources
- Operating equipment at excessive volume causing distortion or clipping
- Removing liquid detection labels or safety tags
• Sub-hiring, lending, relocating or modifying equipment without approval
Damage, Loss & Theft
The Hirer assumes full responsibility during the hire period. Any damage caused by misuse or negligence is payable by the Hirer.
If repairable, authorised repair costs apply. If not repairable, full replacement value at current market rates applies.
Cleaning & Decontamination Fees
A minimum $50 cleaning fee applies for excessive dirt, liquid residue, smoke, sand, mud or adhesive residue.
Delivery & Collection
The Hirer or authorised representative must be present. Failed delivery or delays may incur additional charges.
Cancellations
Refunds apply only in accordance with SNP Entertainment’s published cancellation policy.
Liability & Indemnity
To the extent permitted by law, SNP Entertainment is not liable for injury or damage caused by misuse of equipment.
The Hirer indemnifies SNP Entertainment against all claims arising from use or misuse of the equipment.
The Hirer remains fully responsible under this Agreement at all times, irrespective of whether the Equipment is operated or used by a third party.
Insurance & Recovery
SNP Entertainment may rely on insurance assessments and liquid damage indicators when determining liability.
Insurance excesses and uninsured losses are recoverable from the Hirer.
Breach & Enforcement
Breach may result in debt recovery, legal action, and reporting to authorities. Recovery costs are payable by the Hirer.
Governing Law
These Terms are governed by the laws of Victoria, Australia.
